FSS Wins Judgment for Client and its Employees

A San Diego Superior Court Judge today dismissed FSS's clients, BNSF Railway Company and three freight crewmen, in a wrongful death and negligent infliction of emotional distress case. The case, Terrin v. BNSF Railway Company, City of Carlsbad, et al., involved an adult male pedestrian struck and killed by a freight train at a public grade crossing on Grand Avenue in Carlsbad in August 2014. The man's father and sister sued claiming the conditions that night were dangerous. FSS filed a motion for summary judgment arguing the clients were not negligent and that the claims were preempted by federal law. The Court agreed and entered judgment for FSS's clients. FSS salutes shareholder Jeremy Schroeder for the briefing and victory.
